TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOBWALA365, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Jobwala365 reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defence of such claims. You agree not to settle any such matter without our prior written consent.
Jobwala365 reserves the right to suspend, restrict, or terminate your access to the Site and Services, in whole or in part, at any time and for any reason, with or without notice, including but not limited to violations of these Terms. Upon termination, your right to use the Site and Services will immediately cease. You may also terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, we may retain certain information as required by law or for legitimate business purposes, including maintaining records for legal, tax, audit, or compliance reasons, resolving disputes or enforcing our agreements, and preventing fraud or abuse. Each party shall bear its own costs and expenses relating to the arbitration, and the costs of the arbitrator shall be shared equally between the parties unless the arbitrator orders otherwise.
